Australian PR for Regional TSS 482

The Department of Home Affairs have advised that those holding a Temporary Skill Shortage (“TSS”) 482 visa in an occupation on the Regional Occupation List (“ROL”) and who worked in Australia for at least 12 months between 1 February 2020 and 14 December 2021, may also be able to access the pathway to employer nominated permanent residence (subclass 186) visa in the Temporary Residence Transition stream.

This announcement was made in the Department’s news article dated 13 February 2023 and they’ve since advised that the pathway is available now, with no legislative changes required to give this effect.

This is a welcome addition to those holding a TSS 482 visa in the Short Term Skilled Occupation List (“STSOL”), who have the same access to PR providing they meet the same concession requirements.

The Department of Home Affairs has also confirmed that although the end date of 1 July 2024 for the concessions has been published, it is not included in the legislation and that it will be up to the current Government to decide if this will be enforced - this could open up the options for more TSS 482 visa holders, in an occupation on the ROL and STSOL, to qualify for PR beyond 1 July 2024.
